Cet ouvrage, composé par un professeur de Philosophie enseignant l'éthique médicale en Faculté de Médecine, s'adresse aux étudiants de médecine de 1 re année. Il a pour but de donner les outils conceptuels nécessaires pour identifier les valeurs et les conflits de valeurs en jeu dans les situations médicales de soin, de recherche biomédicale ou de santé publique. Biology has been advancing with explosive pace over the last few years and in so doing has raised a host of ethical issues. Recent years have seen a growing interest in the questions of ethics and aging. Advances in medical technology have created dilemmas for physicians, nurses, and other health care professionals over such questions as the allocation of resources and a patient's "right to die." At the same time, the aging of the American population raises concerns about social policies that involve the role of government. In Ethics in an Aging Society Harry R. Moody examines both the clinical and the policy issues that center around aging. Moody pays special attention to the ethical problems associated with two particularly timely concerns-Alzheimer's disease and the increasingly controversial issue of "rational suicide" for reasons of age. He also focuses on the rights of patients in long-term care and on the question of justice between generations (Are older patients using more than their "fair share" of scarce health care dollars?).

Bien que le mouvement ait été préparé de longue date, il fallut attendre la mise en pratique des innovations les plus spectaculaires de la biologie et de la biomédecine pour que le droit et les juristes mesurent l'importance et la gravité des bouleversemcnts qui allaient en résulter. Les études présentées dans cet ouvrage, sous la direction de Catherine Labrusse-Riou, sont le fruit de travaux effectués au sein d'un séminaire du Diplôme d'études approfondies de Droit privé de l'Université de Paris I ; elles analysent le saisissement, voire l'ébranlement, de l'ordre juridique par ce qu'il est convenu d'appeler " la maîtrise biotechnologique de la vie humaine ". A partir de cas correspondant à des pratiques particulières (la biologisation de la filiation ; l'assurance-vie et le SIDA ; le diagnostic postnatal de prédiction ; le diagnostic préimplantatoire), puis à l'aide de concepts juridiques mis à l'épreuve des faits scientifiques (discriminations biologiques et droit des contrats ; les concepts de patrimoine appliqués aux ressources génétiques ; l'adaptation et la résistance des concepts juridiques aux sciences de la vie), ces recherches affrontent enfin les rapports, à maints égards conflictuels, de la science et du droit, (l'expérimentation en double aveugle ; une controverse entre scientifiques au regard des principes du droit processuel ; les représentations de la science par le droit), toutes questions à propos desquelles se cristallisent, de façon générale et sous couvert des méthodes respectives, des enjeux plus profonds de pouvoir et de légitimité.
